Description:

  • ASIC is seeking a full-time FOI and Privacy Lawyer to join their Legal Services Team
  • Permanent position based in Sydney, Melbourne or Brisbane
  • Salary starting from $114,351 (plus 15.4% superannuation) depending on experience

    The team
    The Legal Services team is responsible for a wide range of legal matters within ASIC including providing advice and oversight in respect of major cases being conducted by ASIC, providing advice on complex or novel regulatory mattersand compliance with ASIC’s statutory obligations.
    This role is a combined role, undertaking work in both the Freedom of Information (FOI) Team and in the Privacy Team. Both teams are part of Legal Services.

The role

  • Act as FOI decision maker in relation to requests for access to documents (including requests for internal review) made under the FOI Act
  • Respond to requests for information from the Office of the Australian Information Commissioner in relation to applications for OAIC review of FOI decisions. This may include briefing and instructing external counsel where appropriate
  • Add value to ASIC’s internal FOI and privacy capability, including through the provision of appropriate training and guidance on both FOI and privacy to junior staff in the teams as well as across ASIC generally
  • Provide sound, practical and timely legal advice on matters affecting ASIC’s privacy obligations in the context of regulatory and operational matters
  • Guide internal teams to conduct Privacy Impact Assessments, and advise teams to develop ASIC notices, forms, regulatory and procedure guides that align with the Privacy Act
  • Assess suspected privacy breaches and assist in containing and mitigating reported privacy incidents.
  • Monitor the regulatory landscape to analyse privacy trends and implement best privacy practice
  • Carry out the shared functions of Privacy Officer under the Privacy Code, including handling internal and external privacy enquiries, privacy complaints, and requests for access to and correction of personal information made under the Privacy Act

About you

  • Bachelor of Laws and/or post graduate qualifications in a relevant field
  • Eligible to hold (as a minimum) a Restricted Government Legal Practicing Certificate in NSW and /or another State or territory
  • Sound knowledge and understanding of the law, practice and policy relating to the Privacy Act and the FOI Act and its application to government agencies
  • Exposure to privacy issues arising in data and technology projects
  • Experience in processing requests under the FOI Act at a senior level including conducting internal reviews and managing reviews to the OAIC
  • Demonstrated experience in interpreting and applying FOI legislation and providing sound advice and guidance in relation to FOI matters at a senior level
  • Experience effectively presenting complex information to different target audiences
