RECRUITMENT INFORMATION
This posting is for the State of Hawaii, Department of Human Services, Administrative Appeals Office.
The position is located in Downtown, Oahu.
MINIMUM QUALIFICATION REQUIREMENTS
LEGAL AUTHORIZATION TO WORK REQUIREMENT: The State of Hawaii requires all persons seeking employment with the government of the State shall be citizens, nationals, or permanent resident aliens of the United States, or eligible under federal law for unrestricted employment in the United States.
EDUCATION: Graduation from an accredited law school with a Juris Doctor degree.
EXPERIENCE: At least five (5) years of litigation/legal experience as a judge, hearings officer, or attorney.
KNOWLEDGE: Knowledge of departmental policies, practices and procedures regarding public assistance, including support services, eligibility for financial and medical assistance, medical provider eligibility or medical insurance claim reimbursement, social services including vocational, child and adult services, and Supplemental Nutrition Assistance Programs; laws concerning public assistance, Hawaii Rules of Evidence and administrative process & procedures. Court filing requirements; English grammar, punctuation, spelling and word usage; general math to complete decisions; and public relations. Understanding of administrative and/or court proceedings.
SKILLS/ABILITIES: Conduct quasi-judicial administrative hearings in a fair and impartial manner and ability to remain neutral during contested hearings. High level of organizational time management, verbal and written communication skills. Ability to interpret and analyze medical, financial, legal, including trust documents, and other records and statements. Strong skills in legal analysis, reasoning, legal research, and legal writing.
Ability to independently plan, organize, and carry out a range of complex assignments with varying workload and issue timely decisions; effectively and tactfully deal with others and explain the AAO hearing process and procedure to clients, attorneys, the public, and other department agencies; read, understand, interpret, apply, research, and analyze applicable State and Federal laws, rules, regulations, statutes, procedures, and policies; write clear, well organized & comprehensive letters, statements, and decisions that include findings of fact, conclusions of law and order; efficiently and promptly process assignments within deadline time frames.
REQUIRED LICENSES: An attorney of good standing admitted to practice law in the State of Hawaii and a valid driver’s license, class 3.
Responsibilities:
The primary purpose of this position is to conduct, as delegated, quasi-judicial due process administrative hearings statewide to adjudicate contested cases from the department’s clients appealing any Department adverse actions made by Benefit, Employment & Support Services (BESSD), MedQUEST (MQD), Social Services (SSD), Division of Vocational Rehabilitation (DVR), and Financial Management Office (FMO); rules on motions and on admissibility of oral and documentary evidence; prepares findings of fact, conclusions of law, orders; conducts pre-hearing conferences; issues subpoenas, oversees post-hearing procedures; and issues written final decisions within the required state and federal deadline timeframes.
