MANAGEMENT POSITION/ DEPUTY DIRECTOR EXPECTATIONS:

• Management level position, supervised by the Assistant Executive Director of the Foundations Unit
• Provide confidential thought partnership with the Assistant Executive Director relating to ongoing Foundations Unit supervision needs and support.
• Facilitate high levels of professionalism and teamwork in addressing the needs of new practitioners to meet the needs of PDMC clients when facing the demands of the courts.
• Support the Executive Director’s organizational values and vision for public defense services by prioritizing ethical workloads and ethical public defense practices.
• Collaborate effectively with executive leadership to improve organizational programs, law school partnerships, develop the public defense workforce at PDMC, improving and strengthening internal processes, policies, and optimizing equitable internal systems.
• Assist with developing, supervising, coaching, and enforcing PDMC office rules, protocols, policies, standards, practices, public messaging regarding the Foundations Unit, and improving the professional reputation and organizational culture at PDMC
• Internal and external support of PDMC efforts towards reasonable workloads for public defenders and client-centered public defense models.
• Attend all necessary management, leadership, human resources, legal skills, organizational, foundation unit, law school, and criminal clinic meetings, training, and classes, as directed by the Assistant ED.
• Participate in ongoing PDMC community partner meetings, OPDC meetings, PDMC-Union Committees, as directed by the Executive Director.
• Supervise PDMC Foundation Unit Attorneys, SPPE Participants, and CLS effectively and professionally. Including developing and implementing Foundation Unit performance agreements, adaptive coaching strategies, attorney performance plans, progressive discipline when necessary, and setting a solid example for legal professionalism and best practices at PDMC.

Oversee and Support SPPE Participants in building and submitting their portfolio examination to the Oregon State Bar at the appropriate time. Follow OSB grading rubrics, Rules for Admission, OPDC policies, and PDMC standards for practicing attorneys.

• Be a model example for ethical legal practices, antiracism efforts, equity, and professionalism.
• Ensure that, among other things, clients are receiving adequate attention, all legal issues are properly spotted and addressed, appropriate motions filed or are in preparation, investigation is appropriate and progressing, and the use of expert witnesses considered and appropriately pursued.
• Train supervised SPPE/ CLS/ and New PDMC attorneys on the proper use of PDMC’s electronic case file systems, adequate and effective use of the electronic file system (MyCase).
• Develop strong working knowledge and adhere to practices and rules outlined in PDMC past “ethical workload” filings in recent Supreme Court Case (Guajardo-McClinton), Updated ABA guidelines for public defense and public defense supervisors, NAPD best practices, OSB formal opinions and ORPCs, the Oregon 6th Amendment Study, the Oregon Project, the Moss Adams PDMC Project (2023), and New National Workload Report published by the RAND corporation (2023).

• Maintain approximately .5 direct representation workload as lead counsel on SPPE/ CLS cases and supervision duties and allow approximately .5 of workload dedicated to direct client representation caseload.
• Regularly check in with supervised Foundation Unit Attorneys, SPPE, and CLS students, and provide them with opportunities to raise any questions and concerns they have. Adequately document any concerns raised and addressed.
• Be available either in-person or remotely/ electronically to discuss issues with team members on an impromptu, ad hoc basis. Maintain an in-person presence in the office consistently and at least four days per week during all regular business hours and with scheduling approval from the AED or ED.
• Providing regular weekly in office hours, training, and regular unit meetings at scheduled times.
• Be available to supervise Foundations Unit Attorneys, SPPE, and CLS court appearances when needed i.e., first meetings, first hearings, first trials, etc. Offer general support for all PDMC attorneys – be available in person or remotely accessible otherwise, to be able to offer needed supervision and support. Provide oversite and litigation assistance for PDMC Attorneys, SPPE, CLS, and New PDMC Attorneys in collaboration with other PDMC Directors.
• Develop and implement new Foundations Unit Attorney/ SPPE/ CLS/ and New PDMC Attorney trainings and ongoing subject matter trainings as needed i.e., trial prep, motion hearings, evidence, ethics, investigation, client management, case file management and documentation …etc. Proactively provide SPPE and CLS support instead of waiting for them to contact you.
• Build and maintain a culture of confidence, approachability, compassion, and guidance for supervised team members at PDMC.
• Observe supervised SPPE/ PDMC CLS/ New PDMC Attorneys/ Law School CLS at court appearances and trials, acknowledge the things done well and identify any areas in need of improvement.
• Conduct random court and client meeting observations of supervised attorneys, SPPE, and CLS.
• Document court observations in detail and in compliance with OPDC Supervision Plan Policy and the PDMC handbook.
• Perform random case file reviews of supervised SPPE/CLS/ and New PDMC Attorneys and document supervising attorney observations and according to PDMC rules, policies, and practices.
• Comply with PDMC workload policy and procedures, informed by national best practices for managing reasonable caseloads .
• Implement work-related performance improvement plans when needed for individual SPPE/ CLS/ and New PDMC attorneys.
• When authorized and approved by the AED and/ or the ED, implement and oversee disciplinary plans of action. Oversee supervised SPPE/ CLS/ New PDMC Attorneys’ disciplinary processes, as outlined in PDMC’s handbook and the current CBA with Union.
• All supervised SPPE/ CLS/ and New PDMC Attorney disciplinary actions must be first approved by the AED and/or the Executive Director.
• Maintain detailed supervision notes and conduct annual performance reviews for supervised SPPE/ CLS/ and New PDMC attorneys.
• Provide written performance evaluations for SPPE/ Employed CLS/ and New PDMC Attorney files to HR Manager and for AED Review.
• Act as a court liaison for PDMC Foundations Unit, SPPE, and CLS, seek feedback judges and court staff regularly regarding individuals’ performance and development.
