Description Job Reporting Relationships Supervised by: Chief Risk Officer Supervises: Compliance Specialist, Compliance Assistant, Loan Quality Control Specialist Basic Qualifications Education/Training: A B.S. or B.A. degree in a related field of study normally required; specialized compliance education and training. Skill(s): Proficient reading, writing, grammar, and mathematics skills; proficient interpersonal relations, communicative, and teaching skills; a thorough knowledge of applicable banking laws and regulations; moderate computer skills; visual and auditory skills; valid driver's license. Experience: A minimum of five (5) years' related experience normally required. CRCM or other professional compliance certification preferred. General Responsibilities Responsible for managing the Compliance Department to ensure that all Bank functions are in compliance with applicable federal, state, and local regulations; implementing strategies to achieve goals assigned to the department as part of the Bank’s annual operating plan; communicating with appropriate management and staff personnel; providing periodic reports. Has authority to make decisions with respect to hiring, firing, demotions, or significant reassignments. Essential Duties 1. Manages the Compliance Department to ensure that all Bank functions are in compliance with applicable federal, state, and local regulations by performing the following: a. Develops and maintains an ongoing risk-based program to ensure the Bank’s compliance with all federal and New York State statutes and regulations governing consumer credit and deposit account products. b. Formulates compliance policies to address the spirit of compliance and nondiscrimination. c. Develops objective standards against which Bank practices and procedures can be evaluated and reviewed. d. Schedules regular reviews and training sessions for Bank personnel on all current laws and regulations. e. Informs personnel about changes in laws and regulations and their implications for Bank policies and procedures. f. Establishes a compliance library and makes available to Bank personnel complete, accurate, and timely information regarding legal/regulatory requirements of various federal, state, and other governmental agencies. g. Reviews forms, notes, documents, contracts, etc., to ensure that current and complying forms are in use. h. Implements a system of ongoing compliance monitoring and testing to identify issues in compliance internal controls and suggest corrective action to address deficiencies and mitigate compliance risk. i. Assists managers in developing procedures for compliant business practices consistent with Bank policy and regulatory requirements. j. Addresses all consumer complaints and notices relating to compliance issues. k. Maintains knowledge of current federal, state, and local regulations and laws affecting all Bank functions. l. Works with Federal and State compliance examiners; takes/recommends action to correct deficiencies. m. Oversees legal processing, including responses to information subpoenas, subpoenas duces tecum, restraining notices, and requests from law enforcement. 2. Implements strategies to achieve goals assigned to the department as part of the Bank’s annual operating plan; assists in the development of the annual budget for the department and adheres to budget parameters. 3. Abides by the current laws and organizational policies and procedures designed and implemented to promote an environment which is free of harassment and other forms of illegal discriminatory behavior in the workplace. 4. Cooperates with, participates in, and supports the adherence to all internal policies, procedures, and practices in support of risk management and overall safety and soundness and the Bank's compliance with all regulatory requirements, e.g., Community Reinvestment Act (CRA), Bank Secrecy Act (BSA), Equal Credit Opportunity Act, etc. 5. Communicates with the Board of Directors, CEO, managers, and appropriate staff personnel to integrate goals and activities. 6. Provides periodic reports to the Board of Directors (or appropriate committee), CEO, and other groups, as required, throughout the Bank. Ancillary Duties Performs tasks which are supportive in nature to the essential functions of the job, but which may be altered or re-designed depending upon individual circumstances.
