Responsibilities

BACKGROUND TO THE ROLE

The TMT practice is a diverse practice dealing with transactional, dispute and advisory work. The data privacy team sits within TMT and is comprised of over 50 partners, legal directors and lawyers working across a network of offices in Amsterdam, Belfast, Birmingham, Dubai, Dublin, Edinburgh, Frankfurt, Glasgow, Hong Kong, Leeds, London, Madrid, Manchester, Munich and Paris.
The team now plays a key role within the wider business, given the business-critical importance of data across all sectors and the need to implement and document appropriate measures where personal data is involved.
In addition, we are advising on novel areas of law, such as online child safety regulations and the evolving legal framework governing artificial intelligence. In parallel, the team works in close collaboration with our contentious data privacy team defending clients in regulatory data protection investigations and providing substantive data protection expertise in litigation matters.

PURPOSE OF THE ROLE

The key elements of the role are:

  • Advising on a full range of data privacy matters, including regulatory compliance, privacy impact assessments, data subject requests, contract negotiation, data protection compliance programmes and international data transfers;
  • Providing subject-matter expertise on data privacy claims and regulatory investigations;
  • Advising on new areas of digital regulation, including AI regulation;
  • Assisting with business development activities in order to win new clients and develop new data workstreams from existing clients - this will involve attending and speaking at conferences, writing articles, and engaging with the key client relationship teams;
  • Providing data privacy specialist input in a contractual/transactional context for IT contracts, services agreements, complex international transfers of data (both intragroup and at arm’s length), data licensing, data sharing agreements, and online terms. While the majority of time will be spent reviewing, drafting and negotiating data privacy related provisions, this may also include an element of IT/commercial drafting more generally; and
  • Supervising junior fee-earners and leading on matters with clients, helping to develop existing relationships with both clients and the teams outside of TMT with whom we work in close collaboration on large shared client mandates.
