A. PROFILE Role Title: Regulatory Legal Manager Reporting to: Chief Regulatory Officer Division: Regulatory Department / Section: Regulatory B. CONTEXT Purpose: The Regulatory Legal Manager is responsible for managing all legal and regulatory matters related to telecommunications operations in Myanmar. The role ensures full compliance with telecom laws, license conditions, and regulatory directives applicable to a Mobile Network Operator, and serves as the primary legal interface with the Ministry of Transport and Communications (MoTC), the Posts and Telecommunications Department (PTD), and other relevant authorities. C. ROLE ACCOUNTABILITIES Overview: Provide expert legal and regulatory support to ensure the company's telecommunications operations comply with Myanmar laws, license conditions, and directives issued by MoTC/PTD. The role manages regulatory filings, legal advisory to business functions, and engagement with authorities/stakeholders to mitigate compliance risks and enable business continuity. 1. Regulatory Legal Compliance Interpret and advise on Myanmar telecommunications laws, rules, notifications, directives, and regulatory orders affecting MNO operations. Ensure compliance with Telecommunications Law, license terms, spectrum conditions, numbering requirements, QoS obligations, and reporting requirements. Maintain oversight of license compliance and regulatory obligations across all business functions. Review regulatory risks and advise management on legal implications of non-compliance. 2. Licensing, Spectrum & Regulatory Filings Manage legal aspects of telecom licenses, amendments, renewals, and regulatory approvals. Provide legal support on spectrum assignments, renewals, refarming, and related regulatory fees. Review and prepare regulatory submissions, compliance reports, and formal correspondence to PTD and MoTC. Support regulatory inspections, audits, and information requests from authorities. 3. Legal Advisory to Business & Operations Provide legal advice to technical, commercial, and operations teams on regulatory compliance matters. Review and advise on interconnection agreements, infrastructure sharing, roaming arrangements and wholesale agreements from a regulatory-law perspective. Support legal assessment of new services, technologies, and network rollouts to ensure regulatory compliance. Advise on consumer protection, SIM registration, lawful interception, data retention, and cybersecurity obligations applicable to MNOs in Myanmar. 4. Government & Regulator Engagement (Legal) Act as the legal focal point for engagement with MoTC, PTD, and other government bodies on regulatory legal matters. Support meetings, hearings, and formal communications with regulators. Coordinate responses to regulatory notices, compliance issues, and enforcement actions. Maintain professional and constructive working relationships with regulatory authorities. 5. Dispute Management & Enforcement Matters Support resolution of regulatory disputes, compliance findings, or enforcement actions. Coordinate with external legal counsel on administrative proceedings, appeals, or litigation related to telecom regulation. Assist in handling regulatory penalties, warnings, or corrective actions. 6. Internal Governance & Reporting Develop internal regulatory legal guidance, compliance checklists, and procedures. Conduct internal awareness sessions on telecom regulatory legal obligations. Prepare regulatory legal updates and risk reports for senior management. Support audits and internal reviews related to regulatory compliance. D. KEY PERFORMANCE INDICATORS All regulatory filings and reports submitted within statutory deadlines (100% on time). Zero major regulatory breaches or penalties attributable to legal advice. Successful management of license/spectrum obligations with no lapses in validity. Timely legal review of business requests (e.g., within 3–5 working days SLA). Positive outcomes in audits and regulatory inspections. E. WORKING RELATIONSHIPS & DECISION MAKING Interacts with: Internal: Technology / Network, Commercial & Marketing, Finance, Legal & Compliance, Risk & Internal Audit, Customer Experience External: MoTC & PTD, Other government Officials, External law firms, Other telecom operators, Industry associations Decision Making Provides independent legal opinions on compliance Approves regulatory submissions before CRO sign-off Escalates high-risk matters to CRO Manages external counsel within delegated budget Recommend potential regulatory initiatives to foster company's competitiveness F. EXPERIENCE AND QUALIFICATIONS Minimum Experience & Essential Knowledge 6–8 years legal experience 3+ years in telecom/regulatory environment Adequate knowledge in: Myanmar Telecom Law Licensing & spectrum QoS, SIM registration Consumer protection Lawful interception Myanmar Investment Law Myanmar Arbitration Law Experience dealing with PTD/MoTC Minimum Entry Qualifications LLB (mandatory) Advocate license (preferred) Compliance / telecom certification (advantage)
