About the role - We are seeking a highly motivated and experienced Regulatory Specialist to join our Compliance team. This critical role is responsible for ensuring the organisation's adherence to all relevant Australian financial services laws and regulations, with a particular focus on the Corporations Act, ASIC regulatory guides, the National Consumer Credit Protection Act (NCCP), and consumer credit legislation. The successful candidate will be the primary liaison for the Australian Securities and Investments Commission (ASIC), manage external audit processes, and oversee regulatory compliance within our lending operations and external relationships. Key Responsibilities - ASIC Engagement: Manage all formal and informal regulatory inquiries, information requests, and consultation papers from ASIC, ensuring timely, accurate, and professional responses. Monitor and analyse new and evolving ASIC regulatory guidance, legislative changes, and enforcement actions to determine the impact on business operations and existing policies. Prepare and manage regulatory filings, breach reporting, and ongoing compliance obligations (e.g., ACL licensing requirements) with ASIC. Maintain a proactive and collaborative relationship with ASIC to manage supervisory matters and regulatory expectations. External Audit and Assurance Management: Lead the coordination and management of all external regulatory and lender audits, serving as the key internal liaison between the external auditors and various business units. Prepare and compile all required documentation, evidence, and management representations for external auditors, ensuring completeness and accuracy. Facilitate and participate in auditor interviews and control walkthroughs with subject matter experts across the business. Track and drive the remediation of all external audit findings and recommendations, working with management to develop and implement effective Management Action Plans (MAPs). Review and assess the final external audit report and management letter, communicating key findings and risks to senior leadership and the Board/Audit Committee. Lending Compliance Management (ACL & Lender Engagement): Oversee and manage compliance with the National Consumer Credit Protection Act 2009 (NCCP) and related Australian Credit Licence (ACL) obligations. Provide expert advice on responsible lending obligations (RLOs) and credit disclosure requirements. Manage the regulatory compliance aspects of engagement with external lenders, aggregators, and third-party service providers. Conduct regulatory due diligence and ongoing monitoring of lender/partner compliance with our internal standards and external regulatory requirements (e.g., NCCP). Review and advise on contractual agreements and service level agreements (SLAs) with lenders to ensure appropriate regulatory protections and obligations are captured. Policy, Advice, and Training: Provide timely, pragmatic, and commercially sound regulatory advice to business stakeholders on compliance matters, new products, and operational changes. Develop, implement, and maintain LMGs Compliance Management System (CMS), including policies, procedures, and internal controls. Design and deliver targeted regulatory training to staff and brokers on compliance obligations and policy changes. To succeed in this role you will bring with you - Required Skills and Experience: Minimum of 5 years of experience in a dedicated Regulatory Compliance, Risk, or Governance role within the Australian Financial Services (FS) industry (Broking, Banking, Credit, Funds Management, or Insurance preferred). Demonstrated, direct experience managing engagement with ASIC (e.g., responding to notices, managing supervisory meetings, regulatory submissions). Experience with ASIC's breach reporting regime (RG 78) for both AFS and credit licensees. Expertise in managing and applying the obligations of an Australian Credit Licence (ACL), including compliance with responsible lending, suitability assessments, and consumer credit laws. Proven ability to successfully manage and coordinate the end-to-end external audit process (regulatory and/or financial audits), including evidence collation and remediation tracking. Strong working knowledge of relevant Australian legislation, including the Corporations Act 2001 and the National Consumer Credit Protection Act 2009 (NCCP). Experience reviewing, advising on, and managing lender/financier relationships and engagements from a regulatory and compliance perspective. Exceptional communication, negotiation, and stakeholder management skills, with the ability to influence at all levels of the organisation. Tertiary qualification in Law, Finance, Commerce, or a related discipline. Desired Experience: Direct experience managing the compliance and reporting obligations related to Corporate Authorised Representatives (CARs) under an Australian Financial Services Licence (AFSL).
