Job Description Post Dimensions -Procurement Projects and Equipment (TGP/PJE) is an operating division of t (TGP). It is composed of eight operational departments/categories including Project Assistance TGP/PJE/AP (PA). This department has a highly senior Industrial Project Support team with a global and multi-energy scope of activity on all the group's projects, and over the entire development cycle. In this context, the Senior Project Contracts and Claims Engineer is responsible for assisting projects from $50M to $5B of CAPEX, with high complexity, for the different branches (E&P, RC, GRP, MS) as well as for TGP framework contracts. - Financial stakes of the claims: Individually in the range of $1 million up to $1 billion. Combined, the stakes of disputes can rise to over $1 billion annually. - HR data: May have to manage TAS contractors. No management within AP but may have to accompany contract engineers in the project teams and may support / coach the development of the skills of Project Contract Engineer and Junior Project Contract Engineer. - Main internal interactions : Transversal coordination of the different TGP entities (Categories, Legal) and other internal entities (OneTech, DARA, BUs , etc.). For claims: DIG, Project Directors, Project Teams (worldwide), E&P Legal, Director of (L)BU. Contributes and participates in the LPG (Legal Project Group) of the headquarters. - External interactions: Relationships with contractors during the tendering and/or project execution phases. For claims: Law firms, Independent Experts, service providers, specialized forums. May be a representative of the group in the context of forums, exhibitions or meetings related to Project Contracts. - Operational data: In the context of project assistance, management of EPC type contract activities. Acts as a link between these projects and TGP's entities. Activities H3SEQ, Governance, Compliance and Integrity: - Actively participate in the deployment of the H3SEQ policies and principles, governance, compliance and integrity of the Company in the context of its activity. Ensure that they are properly taken into account in the projects supported. Actively contribute to the development of the safety culture in PA activities. Promote the use of tools, contractual guides, and support projects in their appropriation. - Participate in the definition and dissemination of best practices and purchasing rules, in line with the Group's requirements (HSE, legal, financial, integrity). Ensure effective communication and concrete implementation within PA and in projects. - Guarantee the consistency of the contracts drawn up with the project teams with the Group's values, commitments and ambitions. 1. Representation - Role of representing TGP/PJE on projects or in subsidiaries, and responsible for carrying out certain files if necessary for committees (Local Contract Committee, TGP Contract Committee, meetings with partners or suppliers) 2. Coordination Transverse - Responsible for the support of all contract engineering activities on the projects on which the Senior Project Contract Engineer is assigned - Improve and participate in the evolution of methods and tools for contract engineering - Carry out reviews related to the audit process of the various projects. Delivers a summary of risks and opportunities, as well as proposals for improvement and corrective actions. - Participate in coordination with TGP/JUR/PJE: definition of needs, sharing of information, coordination of actions within his/her scope of activity, - Actively contribute to the Company's Legal Practice Group (LPG) and take charge of certain actions with his/her team. 3. Project Support Contract Engineer - Provide support for all contract management or procurement activities necessary for the development and/or execution of projects on which the assistance of the Senior Project Contracts Engineer is required - Be able to advise on the implementation of complex tendering processes: CCFT, OBE/OBT, FEED+, etc. - Develop the tender package: commercial structure, contractual terms, ITT - Review offers and negotiate qualifications and exceptions - Evaluate the offers, standardize them, and issue a consolidated RTA with all technical and commercial aspects, anticipating the risks of future execution - Know how to identify and prevent potential claim opportunities for the contractor - Support the project team in the internal governance process, and in particular the monitoring of the Company's purchasing rules and principles 4. Gestion des Claims et Contre-Claims - Define and implement a roadmap on the methods, processes, and tools made available to projects to improve their claim management (prevention, defense, analysis, resolution) - Bring claim/counterclaim expertise to projects for all types of claims - Conduct a review of existing claims, be able to synthesize their respective merits and the Company's exposure, and define a strategy with the project team to guide their resolution - Be able to coordinate a legal opinion on a case, and challenge an opinion issued by an external counsel to the project - Be in charge of coordinating contributions, organizing and participating in the Contract Claim Committee - Analyze industry trends and benchmark of the clients against its peers - Be in charge of the management of certain claims within a project team - Analyze existing claims with the ability to qualify their merit and substantiation - Manage framework agreements with firms specializing in contracts and claims 5. Administration of Contracts in Performance - Be able to administer EPC contracts in the execution phase, in support of the BUs, LBUs, OT/TL/PJC or directly to the project teams. Respond to ad hoc requests for expertise or provide partial or complete contractual support 6. Methodology, REX & Training - Review all the relevant REX available before intervening on a file - Contribute to feedback and continuous improvement of methods and processes - Ensuring the dissemination of good practices and the sharing of experience - Carry out benchmarks on contract types, good contractual practices and claim management. Organize feedback and make recommendations to contract and category managers. - Implement KPIs, tools, action plans and feedback to manage and continuously improve contract and claims activities. - Be able to be a trainer on certain training courses dedicated to contract management in projects (e.g. ICOP) Context and environment - At the heart of the clients' ambition in its energy transition, while ensuring the continuity and performance of its historical activities, TGP contributes to centralizing part of the purchasing and contract engineering activities for all of the Company's subsidiaries and projects. The Senior Project Contracts and Claims Engineer plays a key role in representing the AP (TGP/PJE/AP) entity within the Company's internal customers, as well as applying unified methods and processes to strategic suppliers. - Its main mission is to guarantee the overall performance of the contractual management of projects, ensuring compliance with the objectives in terms of H3SEQ, cost control, and protection of the Company's interests vis-à-vis external stakeholders. - Its internal customers are all of the Group's projects, across all lines of business and all types of business, in compliance with the applicable governance. Purposes - Provide senior contractual support to projects across the Company's various divisions, with a proven ability to influence and guide decisionmaking on complex and high-stakes issues. - Ensure the quality of the support of the contract and claim expertise deployed in the projects by the AP department, guaranteeing the responsiveness, relevance and consistency of the interventions. - Conduct direct negotiations with contractors on strategic files, representing TTE's interests with rigor and efficiency. - Manage the preparation of all applicable contract/procurement governance committees Qualifications Experience and career - Experience: Minimum 15 years of experience in contract management and 10 years in a project team, preferably in the energy sector - Contract Engineering: Excellent knowledge of contract architectures, rules and processes for all phases of project development and execution. Indepth knowledge of the tendering processes is an important criterion. - Project execution: Mastery and excellent knowledge of the project development phases, the stakeholders, the logical sequence of schedules and the challenges of these projects, risks, cost management, etc. - Experience: Participation in large international projects, with direct exposure to contractual aspects, claims management, and relations with contractors and suppliers; Experience in project Contracts & Procurement (C&P) functions is a plus. - Claim & Diswhore: Mastery and excellent knowledge of contract dispute resolution and negotiation processes Skills and personal qualities - Rigor, ability to solve problems, strength of proposal, sense of negotiation, and results orientation. - Ability to work in a multicultural environment - Ability to adapt to diverse topics and changing priorities - Strong ability to manage several subjects in parallel (multitasking), with high responsiveness. - Ability to absorb strong workload peaks related to negotiations involving a large number of actors in an international context. - Autonomous in decision-making.
