EDUCATION:

A law degree from a recognized university (LLB, JD, LLL, BCL)

LANGUAGE REQUIREMENTS:

EXPERIENCE:

  • Significant experience* analyzing complex legal issues** and providing strategic legal advice and recommendations to GIC appointees, senior officials and executives
  • Experience in managing significant financial and complex human resources matters*
  • Experience in legal risk management and litigation management
  • Experience collaborating across business units and maintaining relationships with domestic and international partners
  • Experience navigating complex domestic and international stakeholder environments, including government, industry, Environmental Non-Governmental Organization (ENGOs), Indigenous nations and communities, and the public
  • Significant experience is defined as the depth and breadth of experience normally associated with the performance of those duties for a period of approximately 10 years
    Complex legal issues is defined as the scope and nature involving multiple stakeholders or multiple areas of law or circumstances where sources of information are absent, rare or conflicting.

    Must Include at least three (3) of the following characteristics: multidimensional, sensitive, affecting many partners or stakeholders, precedent setting or having a major impact on the public service.

KNOWLEDGE OF:

  • Deep knowledge of administrative law and quasi-judicial processes and Decision-Making
  • Knowledge of the fundamental principles and operations of regulatory bodies, including general knowledge of the Nuclear Safety and Control Act, the nature of the CNSC and functions of a departmental corporation.
  • Knowledge of Canadian constitutional law, including separation of powers, Charter protections and s.35 affirmation of Indigenous rights

ASSET QUALIFICATION:

  • Experience with a quasi-judicial administrative tribunal – for example, providing legal advice as Counsel, drafting decisions or as an appointed tribunal member
  • Knowledge of Crown law and other relevant legislation, treaties, policies and regulations as they pertain to entities of the Government of Canada
Responsibilities

The Vice President, Legal and Commission Affairs reports to the President of the Canadian Nuclear Safety Commission (CNSC) and plays a key role by:

  • Providing executive management oversight of all legal aspects of the work of the CNSC as a quasi-judicial administrative tribunal
  • Providing executive management oversight of all legal services of the CNSC in-house Legal Services delivered to the President, the executive of the CNSC and the operational regulatory body, including advisory services, legal risk management, litigation management and management of contingent liabilities of the CNSC as a departmental corporation.
  • Managing the operation of the Commission Registry, the organization’s tribunal component, responsible for all aspects of the Commission’s public-facing statutory quasi-judicial administrative tribunal processes and for management of the role of Commission Members.
  • Providing expertise on the maintenance of the effective separation of the quasi-judicial functions of the Commission from the operations of the organization. This includes the provision of governance advice to the President, as well as oversight of the effective delivery of separate Legal and Registry services.
  • Engaging with senior officials across government on emerging legal and policy issues
  • Representing CNSC on internal/external committees and task forces
  • Participating in national domestic and international nuclear law organizations and events, to represent the CNSC’s and Canada’s interests in nuclear regulatory law.
