Do you have significant experience carrying out certification work or do you have extensive experience carrying out investigations of registered certifiers or similar practitioners? Are you ready to make a meaningful contribution and help safeguard the integrity of NSW’s building and development registered certifiers regulatory scheme under the Building and Development Certifiers Act 2018 (BDC Act)? The role You will be responsible for undertaking serious and complex audits and investigations of the conduct of registered certifiers and breaches of the certification legislation. Key requirements: To be successful you will have experience: Reviewing certification work to identify any non-compliances by the registered certifier with the relevant legislative requirements such as the relevant provisions of: The National Construction Code Volumes 1 and 2 The Environmental Planning and Assessment Act 1979, The Environmental Planning and Assessment Regulation 2021 The Environmental Planning and Assessment (Development Certification and Fire Safety) Regulation 2021 State Environmental Planning Policy (Exempt and Complying Development Codes) 2008 The Building and Development Certifiers Act 2018 The Building and Development Certifiers regulation 2020 The Practice Standard for Registered Certifiers Undertaking multiple complex investigations and or audits for regulatory compliance and conduct matters at the same time and completing investigation reports on time, Exercising legislative powers to investigate including obtaining, information, evidence, undertaking formal interviews and obtaining statements in compliance with rules of evidence and procedural fairness. Preparing high quality investigation reports to inform decision making and result in disciplinary action for misconduct or may lead to prosecution for criminal breaches. Key challenges: Understanding the legislative role of registered certifiers under the certification legislation Balancing the support and needs of the team as a people leader while undertaking own complex compliance activities in an agile working environment Essential requirements: Substantial demonstrated experience carrying out certification work as a registered certifier in a building surveyor class of registration or similar substantial demonstrated experience; or Substantial demonstrated experience conducting investigations of registered certifiers or similar investigations. A tertiary building surveying qualification or agreement to obtain a tertiary building surveying qualification considered appropriate by Building Commission NSW. A Certificate IV in Government Investigations or agreement to obtain the Certificate IV in Government Investigations or a qualification considered equivalent by Building Commission NSW.
