Vanuit Schelle werk je voor BESIX Infra Support – het shared service center voor de gespecialiseerde aannemers van de BESIX Group (www.besix.com). We bieden voornamelijk diensten aan voor BESIX Unitec (www.besixunitec.com) en BESIX Infra (www.besixinfra.com), evenals de dochterondernemingen van deze bedrijven. Alle informatie vind je op de websites. BESIX Infra Support is opzoek naar een LEGAL Counsel voor haar vestiging in Schelle. Functieomschrijving BESIX Infra Support werft een Legal Counsel aan om het "Legal & Contract team" in Schelle te versterken. Als Legal Counsel ben je verantwoordelijk voor een breed scala aan contractuele zaken voor de projecten waarvoor je bent aangesteld. Je bent verantwoordelijk van business opportunities tot aanbestedingsfase, contractonderhandelingen en projectuitvoering tot de afsluiting van de projecten. Daartoe behoren onder andere: Het voorbereiden van de benodigde MoU's, Prebid JV/consortium overeenkomsten en alle andere vereiste contractuele documentatie. Beoordelen en wijzigen van (hoofd)contracten en andere overeenkomsten (waaronder overheidsopdrachten / marchés publics en PPP's), standaardcontracten, algemene voorwaarden met het oog op eerlijke en evenwichtige contractvoorwaarden. Deelnemen aan het projectonderhandelingsproces. Na gunning van het project, voorbereiden, onderhandelen en afronden van de JV/consortiumovereenkomst voor het project, eventueel met hulp van een bedrijfsjurist. Tijdens de opstartfase, voorbereiden en geven van contractbriefing om het professionele beheer van het hoofdcontract en de onderaanneming(en) te vergemakkelijken. Tijdens de uitvoering van het project: Adviseren en/of assisteren bij de voorbereiding en onderhandeling van elk onderaannemingscontract, Zorgen voor en/of toezien op de opvolging van contractgerelateerde correspondentie, hetzij persoonlijk, hetzij in voorkomend geval met een contractbeheerder/administrateur, Samen met de Project Manager de claim-, (pre-)geschillenstrategie bepalen, zowel ten opzichte van de klant en/of de onderaannemers of andere, Opstellen van de vereiste documentatie, historiek, verhaal, bijzonderheden, ... Verstrekken van juridisch en contractueel advies met betrekking tot de activiteiten van de Groep, voornamelijk op nationaal niveau. Zorgen voor een goed beheer van geschillen met externe advocaten. Training over contractuele zaken en het creëren van op elkaar afgestemde kennis en aanpak. Rapporteren van alle contractuele zaken en geschillen volgens de regels van BESIX. Functie-eisen Je hebt een Belgische master in de rechten. Je hebt minstens 5 jaar relevante ervaring als advocaat of als bedrijfsjurist in de bouw- en vastgoedsector. Ervaring met FIDIC-overeenkomsten is een pluspunt. Je spreekt vloeiend Frans of Nederlands (uitstekende schriftelijke en mondelinge vaardigheden) met bij voorkeur een goede kennis van het Engels, zowel schriftelijk als mondeling. Je hebt sterke analytische vaardigheden en een pragmatische zakelijke aanpak. Je hebt sterke communicatieve en interpersoonlijke vaardigheden en kan werken in een veeleisende omgeving. Je bent in staat en bereid om de contractuele belangen van de Groep te verdedigen en deze zowel intern als extern uit te dragen.
