    The team
    ASIC’s Enforcement and Compliance Group (ECG) is responsible for the conduct of ASIC’s initial inquiries, compliance and enforcement work across all sectors excluding markets. The ECG comprises Investigation and Enforcement Action, Enforcement Inquiries and Compliance, Enforcement Services and Enforcement Policy and Practice.
    The ECG is establishing a dedicated team to focus on criminal investigations using innovative approaches, including the use of analytical tools and forensic and accounting support to expedite investigations and refer criminal briefs to the Commonwealth Director of Public Prosecutions (CDPP).
    The role

As a Senior Investigator / Investigator you will be accountable for:

  • Managing or leading and contributing to investigations into suspected criminal misconduct by developing investigation strategy, planning, and conducting the investigation, leading staff, and managing resources to ensure a timely and effective outcome.
  • Planning and scoping investigations, identifying the most appropriate investigative approach.
  • Employing a range of evidence gathering techniques including conducting examinations, interviewing witnesses, taking witness statements, and undertaking document review using electronic tools.
  • Analysing collected evidence utilising technology and relevant legal knowledge and develop appropriate case theories and actively progress investigations.
  • Identifying issues arising in investigations that present challenges and overcoming these – these may be technical, practical, or legal in nature.
  • Guiding team members in the development of investigation strategy, planning and conduct of the investigation.
  • Utilising technology to analyse data, information and documentation in order to identify and present relevant evidence to efficiently and actively progress investigations.
  • interviewing and obtaining information from a range of witnesses and developing relationships with witnesses.

Responsibilities:

AS A LAWYER YOU WILL BE ACCOUNTABLE FOR:

  • Identifying issues including legal issues arising in investigations that present challenges and overcoming these. This may include advice as to evidence required to prove contraventions of legislation, admissibility of evidence in Court and the use of ASIC’s statutory powers or other technical, practical, or legal issues.
  • Contributing to investigations into suspected criminal misconduct by developing investigation and legal strategy, planning and conducting the investigation, leading staff and managing resources to ensure a timely and effective outcome.
  • Assisting to plan and scope investigations, identifying the most appropriate investigative approach.
  • Identifying legal issues and provide legal input into investigations.
  • Employing a range of evidence gathering techniques including conducting examinations, interviewing witnesses, taking complex statements and undertaking document review using electronic tools.
  • Analyse collected evidence utilising technology and relevant legal knowledge and develop appropriate case theories and actively progress investigations.
