SUMMARY

The Assistant District Attorney position is in the Cold Case Division for the Charlotte-Mecklenburg Police Department. Candidate must be knowledgeable and well-informed in North Carolina criminal law and procedure and should possess or be able to quickly obtain considerable knowledge of the following: constitutional, federal, state and local laws relevant to advising law enforcement officers and civilians employed by the Department.

KNOWLEDGE, SKILLS & ABILITIES

  • Mecklenburg County District Attorney’s Office policies and procedures including papering guidelines from 1980-present
  • North Carolina Sentencing Laws related to Pre-Fair Sentencing, Fair Sentencing and Structured Sentencing
  • Federal, state and local laws, court procedures, precedents, government regulations, executive orders, and agency rules related to law enforcement
  • The structure and content of the English language including the meaning and spelling of words, rules of composition, and grammar
  • Word processing, managing files and records, and other office procedures and terminology
  • Group behavior and dynamics, societal trends and influences, ethnicity, and cultures.
  • CMPD lab policies and procedures as they pertain to testing of physical evidence in violent crime Cold Case cases including involvement of outside labs in grant cases
  • Procedures surrounding research of unsolved violent crime cold cases involving emerging scientific investigative tools
  • Institutional Knowledge and experience of the CMPD Cold Case Unit as well as The Mecklenburg County District Attorney’s Office
  • Grant requirements including, but not limited to, grant reporting and interagency assistance efforts

PHYSICAL REQUIREMENTS:

  • Essential and marginal functions may require maintaining physical condition necessary for sitting, standing, climbing, or walking extended periods of time
  • Light to moderate lifting and carrying; some crouching, stooping, squatting, crawling, reaching, pushing, and pulling when performing tasks
  • Adequate vision, hearing, and speech required

SENSORY REQUIREMENTS:

  • Concentrated and attentive use of one or more senses (visual, audio, and other sensory modalities) for proof reading, data entry, tabulating data
  • Ability to operate in an environment with frequent interruptions from people and or noises, which in return could result in some level of stress, fatigue, or strain
  • Comprehensive of written information in work related documents
  • Ability to hear, understand, and distinguish speech

PREFERRED QUALIFICATION

  • Graduation from ABA accredited law school and five years’ experience practicing law with 3 years’ experience in or with law enforcement including experience as a North Carolina prosecutor
  • License to practice law in North Carolina
  • Membership in good standing with the North Carolina Bar

MINIMUM QUALIFICATIONS

Doctorate Degree (Professional) and three years related work experience

Responsibilities:

  • Perform complex legal research electronically and manually as it pertains to cold case violent crime laws
  • Recommend prosecution decisions on behalf of Mecklenburg County DA Office and Charlotte Mecklenburg Police
  • Research and prepare cases for prosecution
  • Prosecute cases as needed.
  • Analyze and interpret the constitution, statutes, court decisions, regulations, and ordinances for the department and the City
  • Prepare and provide presentations for various groups including grant-related audiences
  • Review, prepare and draft legal documents,
  • Confer and work with colleagues and staff to establish and verify consistent legal advice to the Department and the City
  • Draft and interpret legislation and recommend policy changes to reflect changes in the law
  • Prepare and argue motions for detectives and officers to assist with criminal investigations and administrative investigations
  • Participate in both the Violent Crimes multidisciplinary groups perform complex cold case legal research, recommend prosecution decisions, prosecute cases as needed, analyze and interpret legal documents, prepare and argue motions for CMPD officers and detectives and participate in multidisciplinary team meetings
