YOUR SKILLS AND EXPERIENCE

  • Bachelor’s degree in Law, Business, Quantity Surveying, Engineering, or a related field
  • Minimum of 10 years of experience in commercial contract management, preferably within an engineering consultancy or construction environment.
  • Proven track record of managing large-scale, multi-million-dollar contracts in the Middle East, with experience in Saudi Arabia preferred.
  • Strong commercial acumen with deep knowledge of FIDIC contracts and other relevant frameworks.
  • Expertise in contract negotiation, cost control, and financial forecasting.
  • Experience managing commercial risks and disputes in complex project environments.
  • Proficiency in contract management software and MS Office Suite
  • Fluency in English is essential, Arabic is an advantage.

YOUR KEY DUTIES

Buro Happold is seeking a highly experienced and accomplished Commercial Contracts Manager with expertise in major projects Commercial and Contracts Management to join our esteemed team. The Commercial Contracts Manager will oversee the commercial and contractual activities of a major engineering consultancy project in Riyadh, Saudi Arabia. This role requires managing contract negotiation, cost control, and commercial risk mitigation to ensure profitability and compliance. The successful candidate will work closely with project teams, contractors, and clients, ensuring that all contracts are aligned with commercial objectives and executed within agreed terms.

Contractual and Commercial Strategy

  • Develop and implement commercial strategies that align with project goals and optimize financial outcomes.
  • Lead the preparation, negotiation, and finalization of consultancy, contractor, and supplier contracts, ensuring favourable commercial terms for the company.

Contract Administration

  • Oversee the administration of all contracts, ensuring adherence to commercial terms, timelines, and budgetary constraints.
  • Track contract performance and financial implications, ensuring timely invoicing, payment tracking, and cost forecasting.
  • Manage variations, claims, and change orders, ensuring they are captured and reflected in financial reporting.

Financial Management

  • Ensure cost control measures are in place to monitor project budgets, cash flows, and profitability.
  • Provide commercial support to project teams, offering insights into budget impacts and strategies to improve financial performance.
  • Lead the assessment of contract variations and claims, ensuring timely resolution to maximize financial returns.

Risk Management and Mitigation

  • Identify and mitigate commercial risks throughout the contract lifecycle, advising on contractual provisions that protect the company’s interests.
  • Establish and maintain a comprehensive risk register for the project, regularly updating senior management on mitigation strategies.

Contract Negotiation and Compliance

  • Negotiate contract terms with clients, contractors, and subcontractors, ensuring that all contracts are favourable and comply with local and international regulations.
  • Ensure contracts comply with Saudi legal requirements and company policies, with a focus on maximizing commercial opportunities and minimizing liabilities.

Stakeholder Management

  • Act as the key commercial liaison between the project team, client, and subcontractors, ensuring all parties are aligned on commercial deliverables.
  • Provide commercial and contractual advice to internal stakeholders, including project managers, finance teams, and legal advisors.

Dispute Resolution

  • Handle commercial disputes or claims, working with legal teams to resolve issues related to non-performance, delays, or variations.
  • Manage any formal dispute resolution processes, including arbitration or litigation, if required.

Reporting and Analysis

  • Produce regular commercial reports for senior management, providing insights into contract performance, risk exposure, and financial progress.
  • Conduct detailed contract analysis to ensure all commercial targets are being met and recommend actions to improve profitability.
