Description:

KNOWLEDGE, SKILLS AND EXPERIENCE:

The main knowledge, skills and experience required of the Commercial Manager are outlined as follows:
Minimum of 10 years’ experience working in a similar role, preferably in the Civil Engineering Sector.
Minimum of a Honours Degree in a relevant Quantity Surveying Qualification.
Chartered Surveyor preferable.
Competent understanding of international, local and bespoke forms of contract such as FIDIC, NEC, IChemE, PWC, etc.
Experience in compiling and drafting contractual entitlements is essential.
Experience in leading final account discussions required and experience in dispute resolution desirable.
Ability to use own initiative, problem solve and adjust as issues arise during contract.
Excellent working knowledge of MS packages such as Word, Excel, Powerpoint and Project.
Strong communication skills with a high level of motivation.
Full Driving License.

Responsibilities:

THE ROLE:

As Commercial Manager, you will work as part of the senior commercial team to protect the best interests of the company. You will be involved in Contracts from tender stage through to delivery and into final account. Reporting into the UK Commercial Manager you will assess risk and opportunity, limit exposure, recover entitlement and ensure business performance is achieved.
In this client-facing role you will uphold our core values and inspire a culture of trust and collaboration with our clients and respective delivery teams. You will work closely with the delivery and pre-contract tendering teams to support them in the most beneficial way possible and contribute to overall business strategy.

MAIN DUTIES AND RESPONSIBILITIES:

The main duties and responsibilities of the Commercial Manager are outlined as follows:
Work as part of a team in the commercial oversight of multiple programmes and projects, embracing the ethos of a “one team” culture.
Respect, adhere and enhance Health, Safety, Environmental & Sustainability standards.
Work closely with all key stakeholders including clients, client representatives and third-party agencies.
Ensure our values of integrity, collaboration, courage, agility and accountability are upheld in day-to-day operations and interactions with our clients.
Development and implementation of project-specific commercial/contract strategies.
Develop, negotiate and manage all commercial agreements/contracts to mitigate risks and optimise opportunities.
Review contract specifications and scopes with stakeholders to identify risks or gaps in the project plans and support the Project/Contracts Manager in the development and implementation of a risk management plan.
Manage cashflow on projects and ensure interim payment applications are submitted on-time to the client by the project delivery teams. Ensure the Project/Contracts Manager is aware of the cash position.
Liaise closely with the Financial Department on project financials, bonds, payments, bank guarantees and collateral warranties.
Review any new prospective Contracts at tender stage for potential risk exposure, and liaise with clients to relay any concerns arising.
Support project delivery teams in the commercial management of contractual issues arising during the delivery of contracts.
Be aware of any changes in legislation, geopolitical issues, or weather events which may affect the delivery of contracts. Support project delivery teams in ensuring protection and recovery, if required, because of these events.
Analyse and report on complex situations and potential opportunities/risks of variations to cost or programme.
Build relationships with equivalent client-side commercial leads and instil an ethos of trust and collaboration.
Support the delivery team in the appointment of key packages including final negotiations and supplier/sub-contract agreements.
Work with delivery teams to develop final accounts, and liaise with the clients to try to resolve these final accounts.
Provide or seek legal opinion on any contractual issues arising and provide sound advice on how to deal with issues arising.
Lead escalation of any disputes in dispute resolution forums with the support of project delivery teams.
Build and promote industry-leading teams by providing training and mentoring of staff. Stimulate every member of the team, setting goals that will help them feel part of their results.
Present on the commercial performance of projects from time to time as may be required. Ensure best practice commercial reporting in a monthly cycle of payment applications, earned value reporting, budget review/monitoring and adjustment as necessary.
Seek to improve the commercial management processes by providing lessons learned feedback and innovative solutions for adoption on future contracts.
Become an active member of the cross-functional project team, liaising with delivery teams, procurement, finance, technical and other functions to identify areas of potential concern and resolve them before they become issues.
Work self-motivated and autonomously if required.
Keep appraised of the latest standards and technology through continuous professional development (CPD).
Other duties as required from time to time.
