Description:

KNOWLEDGE OF:

    Ability to:
  10. Apply knowledge of state/federal regulations related to Title IX to analyze complaints, determine if methods and procedures need to be developed, or modified to ensure compliance, advise District administrators, conduct investigations, arrive at conclusions, make determinations, and develop training materials.
  11. Use appropriate investigation techniques, methods, and best practices to conduct, coordinate, track, manage, and organize investigations.
  12. Communicate with others on confidential and sensitive issues.
  13. Objectively and effectively investigate complaints of alleged unlawful discrimination, sexual harassment, and other violations of rights relative to assigned program areas, prepare reports, and make findings and recommendations related to law and legal precedence.
  14. Be open to change and new methods in the assigned area of responsibility.
  15. Work cooperatively and productively with internal and external constituencies.
  16. Advocate for shared governance, collegiality, staff cohesiveness, and the core values of the institution.

EDUCATION, TRAINING AND EXPERIENCE:

Bachelor’s degree in Human Resources, Public Administration, or a related field and six (6) years’ experience conducting investigations alleging employee misconduct, unlawful discrimination, sexual harassment, retaliation complaints, and grievance resolutions; or a Juris Doctor (JD) degree and two (2) years’ experience conducting investigations alleging unlawful discrimination, sexual harassment, retaliation complaints, and grievance resolutions; or an equivalent combination of training and experience.

LICENSES; CERTIFICATES; SPECIAL REQUIREMENTS:

May require a valid California driver’s license and the ability to maintain insurability under the District’s vehicle insurance policy.

Responsibilities:

GENERAL PURPOSE

Under the direction of the Associate Vice President- Human Resources, or designee, the Director, Title IX & Compliance Programs position is responsible for planning, directing, and coordinating a variety of advanced investigatory, administrative, and compliance related duties in support of District, state, and federal policies, procedures, laws, and requirements pertaining to civil rights, compliance, employment, equity, and human resources functions. Oversees and directs District programs, investigations, formal, and informal resolution related to Title IX, unlawful discrimination and harassment complaints, employee relations, ombudsperson complaints, grievances, EEOC/CRD complaints, and other regulatory agency complaints. Supports responses to lawsuits, and facilitating alternative dispute resolution, including settlement and mediation. Assists in administering the District’s Equal Employment Opportunity Plan. Assists in the maintenance and revisions of Human Resources Board policies, administrative procedures, and employee handbooks. Develops and facilitates training programs and professional development related to compliance. Performs related duties as assigned.

ESSENTIAL DUTIES AND RESPONSIBILITIES

1. Directs, coordinates, manages, tracks, analyzes, and investigates complaints pursuant to California law, Title 5 and ADA, Title VII, Title IX, other relevant regulations and statues, policies, and administrative procedures, in accordance with specified timelines, to look into alleged violations of civil rights including, but not limited to, discrimination, gender equity, sexual harassment, accessibility for individuals with disabilities, and other related policies; prepares and issues correspondence and reports including, but not limited to detailed findings, conclusions, and recommendations; maintains databases, reports, and files related to complaints. E
2. Facilitates, within specific time lines and constraints, informal resolution of discrimination, harassment, and sexual misconduct complaints as appropriate and permissible by law. Documents efforts and conclusion of informal resolutions. E
3. Practices and provides alternative dispute resolutions/settlements including the ombudsperson program and mediation. E
4. Provides support in responding to various lawsuits.
5. Assists in investigating and resolving regulatory agency complaints including complaints from, but not limited to, EEOC, CRD, and OCR. E
6. Advises administrators, faculty, staff, students, applicants, and the public of their rights, privileges, and of procedures for filing complaints, grievances, and appeals; confers with concerned parties in an effort to resolve relevant concerns and complaints at the earliest possible point in the process. E
7. Develops procedures, practices, and systems to promote diversity, equity, and inclusion to assure compliance with applicable diversity, civil rights, equal employment opportunity, gender equity, and related laws, regulations, policies, guidelines, and agreements. E
8. Develops and implements training and development activities for administrators, faculty, staff, and students to increase awareness and sensitivity to diversity, civil rights, gender equity, accessibility for individuals with disabilities, equal employment opportunity policies and related matters.
9. Collects, compiles, analyzes, interprets, and presents information and statistical data related to assigned responsibilities to provide support and/or justification for investigations, and for training, policy and system changes, and updates. E
10. Establishes and maintains effective working relationships with administrators, faculty, staff, and students and with representatives of federal, state, and local agencies, commissions, and
committees. E
11. Analyzes the possible effects of proposed legislation and regulations related to compliance and makes recommendations based on findings. E
12. Prepares a variety of descriptive and evaluative reports, correspondence, and communications, including workforce and applicant pool analyses for EEO and diversity monitoring and reporting purposes. E
13. Attends and participates in committees to provide subject matter advice and guidance related to assigned responsibilities.
14. Coordinates, investigates, and prepares detailed investigative reports, and implements procedures to respond to internal and external complaints or allegations regarding unlawful discrimination, harassment, and/or retaliation. E
15. Supervises, trains, and assists other Human Resources personnel.
16. Assists Human Resources Administrators with related matters as directed.
17. Represents the department at District-wide events and meetings and participates in/on a variety of committees.
18. Performs other duties as assigned.
