Position Overview: The Land Acquisition Counsel will be responsible for ensuring that all land acquisition deals are thoroughly vetted, and due diligence is completed. This role involves drafting and reviewing land contracts, as well as addressing any legal issues related to land acquisition. The Land Acquisition Counsel will report directly to the VP of Land and will not currently have any direct reports.
EDUCATION & EXPERIENCE REQUIREMENTS:
- Licensed to practice law in the state of UT
- Strong background in real estate law, land use, and property law
- Additional certifications in environmental law, zoning, contract law, or urban planning preferred
- Experience drafting and negotiating land acquisition contracts, purchase agreements, and due diligence reports.
- Familiarity with land entitlements, zoning ordinances, and municipal regulations related to residential developments
- A background in real estate-related litigation or dispute resolution, particularly involving eminent domain, land rights disputes, or contractual issues in acquisitions.
- Strong expertise in negotiating complex transactions related to land acquisition, including joint ventures, partnerships, and financing agreements.
- Understanding of state, federal, and local regulations affecting land use, including environmental laws, zoning, and permitting.
- Ability to work closely with land acquisition teams, planners, construction teams, and external consultants to ensure legal compliance and successful project development.

Responsibilities:
- Conduct and oversee comprehensive due diligence on potential land acquisitions, understanding the project’s water needs and ensuring the deal is structured to meet these requirements. This includes thorough title searches, environmental assessments, zoning compliance, and verification of water availability to fulfill project demands.
- Draft, review, produce, land acquisition contracts and agreements.
- Provide legal advice and support on all matters related to land acquisition.
- Ensure compliance with all relevant laws and regulations.
- Ensure municipalities adhere to local and state laws to protect Visionary Homes’ rights, and professionally challenge non-compliance with applicable ordinances.
- This role involves monitoring legal adherence and advocating for Visionary Homes when necessary.
- Collaborate with the Director of Land Acquisition and other team members to facilitate smooth transactions and efficient processing of land deals.
- Address and resolve any legal issues that arise during the land acquisition process.
- Maintain up-to-date knowledge of real estate laws and regulations.
- Develop and maintain relationships with landowners, brokers, and other stakeholders.
- When necessary, negotiate purchase agreements with landowners, ensuring favorable terms and conditions.
