    The team
    ASIC’s Enforcement and Compliance Group (ECG) is responsible for the conduct of ASIC’s initial inquiries, compliance and enforcement work across all sectors excluding markets. The ECG comprises Investigation and Enforcement Action, Enforcement Inquiries and Compliance, Enforcement Services and Enforcement Policy and Practice
    The role

Responsibilities:

  • Guide investigative teams in the development of investigation strategy, legal issues, planning and conduct of the investigation.
  • utilise technology to analyse data, information and documentation in order toidentify and present relevant evidence actively progress investigations.
  • identify issues including complex legal issues arising in investigations.
  • interview and obtain information from a range of witnesses, and developing relationships with witnesses.
  • give evidence at civil and criminal hearings about investigations.
  • communicate with external parties in relation to issues arising during the course of the investigation, and
  • assist in the compilation of briefs for the Commonwealth Director of Public Prosecution (CDPP) and assisting them to prepare and conduct criminal prosecutions,
  • compile administrative briefs to ASIC delegates, liaising with delegates and representing ASIC at administrative hearings.
  • provide written and oral briefings to Senior Executives, Executive Directors and Commissioners, and
  • coach and mentor less experienced staff.

About you

  • Must have a Bachelor’s Degree in Law, admission to the Supreme Court of an Australian State or Territory as a solicitor or barrister and must hold (or be eligible) a current legal practicing certificate from the relevant State law society
  • Significant experience in a senior role that involved investigation, case management, evidence gathering processes, project management or detection of misconduct, including the conduct of civil litigation and/or the preparation of criminal briefs of evidence.
  • Experience in conducting complex civil litigation.
  • Understanding of the law, practice and policy relating to the Corporations Act, the National Consumer Credit regime, the ASIC Act and other relevant financial services legislation.
  • Strong legislative and evidence analysis skills
  • Highly developed writing and drafting skills, and the ability to communicate verbally in a clear, concise and persuasive manner.
  • Demonstrated ability to use digital investigative tools
  • Confidence presenting, building rapport, interviewing, and advocating an organisation’s position in the context of complex issues.
  • Experience in guiding and coaching other team members.
