Global Legal plays an important role in protecting the Group’s reputation by helping to future-proof the organization through robust legal risk and issue advisory. Responsible for providing comprehensive legal advice to senior management and all global businesses and functions, the team offers a diverse range of legal skills, jurisdictional experience and practice specialisms across all countries and territories in which our businesses operate.
We are currently seeking an experienced professional to join this team in the role of Legal Counsel.

Principal Accountabilities:

  • To act as the legal counsel supporting Markets and Securities Services (MSS).
  • To work with the MSS Business Lead Lawyer to implement and communicate the strategic and operational objectives of the Global Legal Function across the Conventional and Amanah business and identify, formulate and communicate policies and procedures in line with these objectives.
  • To provide proactive legal advice, guidance and support to Conventional and Amanah, and to other business areas and functions as required to ensure that the Group’s exposure to legal risk is managed effectively.
  • To back up MSS Business Lead Lawyer in representing the legal function in MSS business governance forum such as MSS Business and Local Risk Committees.
  • Works under the supervision of the MSS Business Lead Lawyer, but will work independently on routine matters.
  • Ability to prioritize workloads in terms of legal risk and commercial consideration.
  • Maintain knowledge of HSBC Group operations and policies.
  • Ability to handle tasks with less supervision.
  • Enhanced relationship with higher levels of management inspiring confidence of customers/stakeholders.
  • The jobholder assists the General Counsel MYH LGA, the Senior Legal Counsel / MSS Business Lead Lawyer and colleagues to manage legal risk across MSS in accordance with established policies and procedures. The diversity of HSBC’s business, its geographic spread and the constant changes internally and externally means the diversity of matters which the jobholder is required to manage and advise on is very wide.
  • The role requires an understanding of the structure of the HSBC Group and its culture and the ability to handle increasingly complex legal issues.
  • The jobholder must also establish close mutually supportive working relationships with other members of the local legal team and the Global Legal Function.
  • Works independently, but seeks SME input on unusual situations, highly complex issues, and matters that may pose significant legal, financial and / or reputational risk to the HSBC Group.
  • The role requires understanding of the MSS strategy and business. The jobholder is expected to support MSS business of HSBC Bank Malaysia Berhad and HSBC Amanah Malaysia Berhad, HSBC (Malaysia) Trustee Bhd; also include Global Functions. The jobholder is expected to also possess strong knowledge in Islamic finance in Malaysia and working knowledge of Shariah principles for the purpose of providing guidance and support on MSS transactional matters.
  • Maintain and observe HSBC internal control standards, implement and observe Group Compliance Policy, including the timely implementation of recommendations made by internal/external auditors and external regulators. Foster a compliance culture and implement Group Compliance Policy by managing compliance risk in liaison with the Regulatory Compliance and Financial Crime Compliance functions.
  • The role requires understanding of the MSS strategy and business. The jobholder is expected to support MSS business of HSBC Bank Malaysia Berhad and HSBC Amanah Malaysia Berhad, HSBC (Malaysia) Trustee Bhd; also include Global Functions. Requirements

  • Qualified lawyer with five to ten years of relevant experience.
  • Minimum degree qualification is preferred.
  • Knowledge and experience of markets, derivatives, banking, corporate and securities law concepts and a working knowledge of the laws in the major jurisdictions in which HSBC operates.
  • Corporate experience and Compliance experience an advantage, but not essential.
  • Good knowledge of the HSBC Group corporate structures, its business and personnel and a clear understanding of HSBC’s corporate culture.
  • Ability to prioritise and multitask.
  • Good inter-personal skills and ability to build relationships across business lines and within Legal.
  • Developing lateral thinking / problem solving skills.
  • Developing ability to influence.
