As part of Global Risk, Regulatory Compliance ensures adherence to applicable regulations and standards by setting the policies which cover HSBC’s regulatory requirements, and mitigate conduct and reputational risk issues. The team strives to remain ahead of the regulatory change agenda and ensures the business understands the implications and is prepared for change. It monitors how the Global
Businesses and Functions manage their responsibilities with regard to complying with the regulations and helps resolve compliance deficiencies.
The Recovery team members are responsible for portfolios of wholesale accounts, where the bank is on an exit strategy for the customer and now seeking to maximise recoveries and/or minimize losses.

Responsibilities:

THE ROLE:

In this role you will be required to be able to advise and guide others on legal aspects of SCU cases, as well as manage portfolios where the cases are in a legal phase or requiring a deep understanding of legal and contractual aspects. You will be involved in both complex and non-complex recovery cases managed by the SCU team.

In this role you will be responsible for:

  • Remaining up to date on insolvency and enforcement law in UAE, as well as relevant aspects of Companies and Transactions Laws and any other laws as relevant to the job
  • Guiding others in legal aspects as well as Court frameworks etc.
  • Managing portfolios of cases, largely with legal aspects to be resolved.
  • Providing legal learning sessions to wider stakeholders within the bank where helpful
  • Updating legal aspects of the divisions operating manual where required
  • Adoption and implementation of HSBC/SCU procedures and processes to protect the Bank’s capital by making a full assessment of all relevant risks, creating and implementing appropriate strategies, optimising facility structures and minimising impairments/maximising recoveries
  • Adoption and implementation of Special Credit Unit’s VACS (Vulnerability, Affordability, Consensual, Support) principles and the Lending Standards Board’s “Standards of Lending Practice”
  • Adoption and implementation of HSBC’s fair customer outcomes values and communicating with customers in a clear, consistent, considerate, constructive, and consensual manner to protect the Bank’s reputation when working with distressed customers.
  • Streamlining of processes and procedures through a focus on improving the efficiency and effectiveness of SCU.
  • Adopt and implement an environment where people are empowered and inspired to gain the necessary skills and knowledge to confidently support customers facing financial difficulty in a variety of complex and non-complex situations and deliver good customer outcomes through every interaction.
  • Promote SCU within CMB and to other stakeholders

Requirements

TO BE SUCCESSFUL IN THE ROLE, YOU SHOULD MEET THE FOLLOWING REQUIREMENTS:

  • Experience with UAE legal system preferably with a law degree.
  • Knowledge of the UAE Court framework
  • Good understanding of UAE bankruptcy code (including various onshore & offshore codes)
  • Ability to understand, interpret and apply legislation across the various jurisdictions (onshore, offshore, different Emirates, Federal and where appropriate, non-UAE
  • A sound knowledge of banking products
  • Financial analytical/Credit & Risk experience preferred
  • Ability to negotiate effectively together with an aptitude to persuade and influence others
  • Networking skills
  • Strong negotiation skills
  • Good communication skills (English and Arabic)
