Description:

Responsibilities:

  • Undertake litigation in disciplinary proceedings before QCAT (on behalf of the Director of Proceedings) including the drafting of referrals, advising on evidence, holding discussions with legal representatives for practitioners and preparing matters for hearing.
  • Undertake other legal actions, including prosecution against the Health Ombudsman as directed.
  • Provide high quality and timely legal services to the Health Ombudsman on more complex matters across a broad range of legal areas affecting or likely to affect the Health Ombudsman. These include statutory interpretation, administrative law, criminal law, evidence, health law, QCAT litigation and procedure and contract law.
  • Manage caseload in QCAT, including complying with directions, timetables and orders issued by QCAT or the Court.
  • Prepare for and attend directions hearings.
  • Prepare show cause notices for interim and permanent prohibition orders for unregistered health providers.
  • Respond to and enter work promptly onto, Content Manager and Resolve and any other case, document and knowledge management systems as shall be in use from time to time.
  • Assist to manage the day-to-day operations of the Legal Services Division to ensure operational and legislatives targets are met, including managing staff workloads, development of best practice processes and providing formal guidance and supervision and ensuring staff function in an effective efficient and economical manner.
  • Form and maintain relationships with internal clients and external stakeholders, including external legal providers, in relation to legal, legislation and legal policy matters.
  • Mentor and supervise junior members of staff on specific tasks as and when required to assist with the provision of legal education to the Legal Services Division.
