MINIMUM REQUIREMENTS:

  • Education/License/Registration/Certification 15 Years of Experience
  • Construction industry experience with relevant bachelor’s degree and/or professional training required
  • Master’s degree and/or advanced certification in related field(s) preferred
  • Accredited degree (or global equivalent) in business, law, engineering, construction management or cost engineering or equivalent experience
  • Requires a comprehensive knowledge of industry business practices and management of contracts and subcontracts
  • Understanding and experience with multinational business environments
  • Experience in pricing, contracts law, contract drafting, administration and negotiation of change orders, risk identification and mitigation, planning, and scheduling
  • Proficiency in the formation and administration of prime contracts and subcontracts through the several steps of bidder pre‐qualification, compilation of bid requests, receipt of bids, bid evaluation, award, monitoring the performance of contractors, back charge procedures, resolution of claims and disputes, and other such related steps
  • Demonstrated leadership and teamwork capabilities suitable for working effectively in a matrix organization and leading a workforce comprised of many nationalities and backgrounds
  • Excellent oral and written communication skills
  • Excellent organization and interpersonal skills
  • Advanced knowledge of Microsoft products (e.g. Word, Excel, Power Point, Outlook, etc.)
  • 20+ years’ experience in the commercial construction industry, with 15+ years of prime contracts management, commercial management, legal, procurement & subcontracts, project controls experience preferred
  • Expert experience in commercial project management, prime contracts management, legal, procurement & subcontracts, project controls, project financial management & reporting
  • Expert experience working with engineering, procurement, and construction/construction management contractors on under varying contracting models and projects of varying size (including ‘mega-project’ large CapEx programs)Experience in construction industry; specific to semiconductor plants, clean rooms and tool installs; design and/or construction of process or clean utility systems

Responsibilities:

DISCOVER YOUR EXCITING ROLE

The Sr. Director, Commercial Management/Prime Contract Management is responsible for program/project leadership of Commercial Management activities and direct oversight of Prime Contract/Claims Management, Change Management, and Project Accounting team members. This includes leading/facilitating the formation and managing/coordinating the administration of the client contract(s) (prime) throughout the life cycle of the program/project. The position requires operational leadership of, oversight on, and performance of commercial and prime contract management execution activities in accordance with contract terms with a view to preventing leakage and ensuring reimbursement for valid changes/claims for time and/or cost relief. The position reports into the Commercial Management operational department for the US and entails program/project responsibility over Commercial Management activities. The position is also accountable to the Project Director and Regional Business Unit (RBU-US) project delivery leadership.
The purpose of this position is to manage and lead the commercial management job duties and functions as listed below with the overall objective of managing, coordinating, and implementing the program/project commercial strategy and execution plan; establishing an execution framework that ensures compliance with contract terms, strategically protects and positions Exyte commercial success, and provides team members with the skills, tools, and support required to deliver best-in-class program/project lifecycle commercial results.

EXPLORE YOUR TASKS AND RESPONSIBILITIES

  • Directs, develops, and implements Client contracting and risk mitigation strategies in partnership with Exyte project, regional and corporate stakeholders
  • Directs prime contract formation/administration activities throughout the lifecycle of the project, including coordination of activities involved with change management and claims processes executed in partnership with Project Controls and Project Management
  • Authors and/or reviews project correspondence to ensure Exyte’s rights are protected and that it is consistent with the terms of the prime contract
  • Provides direct oversight of the project Commercial Management team including Prime Contract/Claim Management, Change Management, and Project Accounting personnel
  • Provides indirect oversight of the project Procurement & Subcontracting team, including providing guidance into purchase order and subcontract prime contract flow-downs, direction on commercial risk mitigation, purchase order and subcontract administration oversight, and management of upstream prime contract interface with downstream contracting activities
  • Manages Commercial Management engagement on financial processes including reporting, Accounts Payable/Accounts Receivable, billing, ERP systems, cash flow, insurance and associated claims with regional support of Finance/Accounting
  • Works with project stakeholders to identify and maintain the prime contract baseline, and provides commercial awareness training to project team members to facilitate project successful execution of contract scope and commercial terms of agreement; including training on prime contract management principles, risk mitigation, support into subcontract formation and administration (including prime contract flow downs), and identification, preparation and resolution of upstream and downstream claims
  • Works with internal stakeholders to understand financial activities, to fund operations, maximize investments, increase efficiency, and build strong relationships with Owner, Consultants and other project stakeholders
  • Closes out all project commercial activities and ensures company policies and procedures are implemented
  • Follows and supports project Supply Chain procedures to close out processes; including the development of contract strategies, bid and contract documents, evaluation, award, settlement of disputes and disagreements; and manages the negotiation of final amounts with Owner
  • Provides support to business and execution units in the formation of prime contract(s) as necessary, including participating in the proposal, prime contract review, joint venture and/or subcontract partnering, and risk assessment process
  • Facilitates smooth transition from prime contract award(s) to execution, as necessary, with the support of the project team throughout life of a project
  • Coordinates with the Legal and Risk Management departments to obtain and provide information regarding commercial issues during all phases of formation and execution of project prime contract(s), as well as coordinate with Commercial Project Management and Project Controls on commercial data analysis
  • Assists Business Development in developing the contract summary in the proposal phase and then update throughout the project in partnership with the Project Director and other Exyte stakeholders
  • Participates in department management team reviews
  • Leads project teams including implementation of efforts targeted at quality control and timely delivery of all products and services
  • Ensures compliance to applicable Exyte policy and procedure
  • Other duties as assigned
