Under the general direction of the Supervising Administrative Law Judge, the Administrative Law Judge (ALJ) presides over appeal matters heard before the Office of Tax Appeals (OTA) individually or as part of a panel of three members, consisting of ALJs, Senior ALJs, Supervising ALJs, Program Specialists, and/or Business Taxes Specialists. The ALJ prepares timely and legally correct written opinions and orders applying OTA’s Rules for Tax Appeals, the California Revenue and Taxation Code, the Internal Revenue Code, relevant provisions of the California Administrative Procedure Act, other relevant or related laws, regulations, rulings, court decisions, and OTA precedent, policies, and procedures. The ALJ’s knowledge of the subject matter covered in the hearings progresses from an entry to journey level, and the ALJ is assigned cases of varying levels of complexity, ranging from simple to complex cases.
