QUALIFICATIONS

To qualify for pay band 4a you must meet the following:
Applicants must have had a minimum of four (4) years of experience in providing legal advisory services or litigation in two or more of the following areas of legal practice: fiscal law, federal personnel and labor and employment law, federal procurement, administrative law, and ethics. This experience must have provided the applicant with the knowledge, skills, and abilities to successfully perform the duties of the position. Note: This experience MUST be well documented within your resume or application.
Highly Desirable: Experience as a technical resource and legal advisor on a variety of labor and employment law issues.
This position has a positive education requirement; therefore, all applicants MUST provide a copy of a transcript demonstrating successful completion of a full course of study (graduation with a JD) in a school of law accredited by the American Bar Association (ABA). Failure to supply such a transcript will result in an incomplete application package.
Bar Membership: Applicant must provide evidence of current, active membership in good standing of the bar of a state, territory of the United States, District of Columbia, or Commonwealth of Puerto Rico. Responsibilities:

  • Serves as an advisor and technical resource to MCC officials and employees by providing ongoing support and legal advisory services with respect to complex and difficult questions impacting MCC administrative programs and operations.
  • Researches and prepares memoranda on legal issues related to the regulations and statutes applicable to MCC’s foreign assistance mission and administrative litigation matters.
  • Represents the agency in Federal procurement matters, including bid protests and contract disputes; claims by the government, including debt collection; and other administrative matters.
  • Provides advice and representation concerning labor and employment statutes, regulations, policies, and procedures. Ensures legal opinions, briefs, memoranda, etc. are fully researched, and contain appropriate legal and policy conclusions.
  • Represents the agency in proceedings before Arbitrators, the Federal Labor Relations Authority, Federal Mediation and Conciliation Service, Equal Employment Opportunity Commission, Merit Systems Protection Board, and various state and federal agencies.
  • Assists on matters involving the FLRA including but not limited to election procedures, union information requests, negotiations, collective bargaining, ULPs, grievances, and arbitrations, inquiries and investigations.
  • Assists with all aspects of the ethics program, including review of required financial disclosure reports, training agency employees on the Standards of Ethical Conduct, and providing advice to employees on a case-by-case basis.
  • Assists MCC’s Chief Freedom of Information Act (FOIA) officer or FOIA Appeal Authority with authority to release or deny all FOIA/Privacy Act requests and on other matters related to FOIA.
  • Work collaboratively with legal advisors and paraprofessionals on the OGC Administrative Law team. Keeps the chain of command informed of appropriate actions, issues, or decisions concerning labor proceedings and issues. Ensures legal opinions, briefs, memoranda, etc. are fully researched, and contain appropriate legal and policy conclusions.
  • Recommends and formulates MCC’s position regarding difficult and complex legal problems and issues that may be controversial or of significant public interest.
  • Performs other duties as assigned.
