This position is located in General Counsel, Richland County.

Are you the one? We are looking for an Attorney III who provides legal opinions and advice to the Department with primary responsibility for advising in areas of Medicaid Third Party Liability, Estate Recovery, and Office of Civil Rights & Privacy.

  • Provides legal advice to Department staff on legal issues that arise related to the Department’s Office of Civil Rights & Privacy, including state and federal privacy and confidentiality statutes and regulations (including HIPAA and Medicaid safeguarding) and state and federal anti-discrimination statutes and regulations (including ADA and Section 1557 of ACA). Provide legal advice to Department’s Ethics Officer, as it related to matters under the Department’s Code of Conduct and the SC Ethics Act.
  • Provides legal advice to Department staff on Medicaid Third Party Liability issues (casualty & insurance) and represents the Department in litigation and negotiation related to third party liability at the trial and appellate levels in both state and federal court. This function includes providing legal opinions to administrative and program staffs in the interpretation of agency policies as they relate to state and federal laws and regulations and recommends appropriate actions.
  • Provides legal advice and represents the Department in legal matters involving Estate Recovery, at the trial and appellate levels in both the state and federal courts, requiring thorough knowledge of highly specialized regulations and procedures. Includes providing legal advice and reviewing of Special Needs Trusts.
  • Provides legal opinions to administrative and program staff in the interpretation of Department policies as they relate to state and federal laws and regulations and recommends appropriate actions. Represents the Department in administrative hearings and at the trial and appellate levels.
