Our client is seeking a talented and experienced Disputes Manager to join their team in Sydney, focusing on major road and rail infrastructure projects.
As the Disputes Manager, the successful candidate will play a critical role in managing disputes, claims, and contractual issues, mitigating risks, and protecting our client’s interests while fostering collaborative relationships with project stakeholders.

REQUIREMENTS:

  • Bachelor’s degree in Law; Master’s degree or legal qualification preferred.
  • Minimum of 7 years of experience in dispute resolution, preferably in the infrastructure, construction, or engineering sectors.
  • Strong understanding of contract law, construction contracts, and dispute resolution mechanisms.
  • Proven track record of successfully managing and resolving disputes, claims, and contractual issues on major infrastructure projects.
  • Excellent negotiation, mediation, and conflict resolution skills, with the ability to achieve mutually beneficial outcomes.
  • Strong analytical and problem-solving skills, with attention to detail and the ability to assess complex legal and commercial issues.
  • Excellent communication and interpersonal skills, with the ability to build rapport and trust with stakeholders at all levels.
  • Ability to work collaboratively in a fast-paced, dynamic environment and manage multiple priorities effectively.
  • Sound judgment, integrity, and professionalism, with a commitment to upholding our client’s values and principles.

Responsibilities:

KEY RESPONSIBILITIES:

  • Lead the management and resolution of disputes, claims, and contractual issues arising from major infrastructure projects, including roads and rail networks.
  • Develop and implement dispute resolution strategies aligned with project objectives and contractual obligations.
  • Conduct thorough analysis and assessment of claims and disputes, identifying legal and commercial risks, and recommending appropriate courses of action.
  • Collaborate with project teams, legal counsel, and external experts to develop and defend claims and counterclaims effectively.
  • Negotiate settlements and agreements with project stakeholders to achieve favourable outcomes and minimise project disruption.
  • Provide proactive advice and support to project teams on contractual matters, risk management, and dispute avoidance strategies.
  • Manage relationships with clients, subcontractors, and other project stakeholders, promoting open communication and constructive dialogue.
  • Ensure compliance with contractual requirements, applicable laws, regulations, and industry standards throughout the dispute resolution process.
  • Prepare and maintain accurate documentation and records related to disputes, claims, and settlements.
  • Represent our client in dispute resolution proceedings, including mediation, arbitration, and litigation, as necessary.
  • Monitor and report on dispute resolution trends, risks, and outcomes, providing insights and recommendations to senior management.
  • Provide training and guidance to project teams on dispute resolution processes, best practices, and lessons learned.
  • Foster a culture of collaboration, integrity, and professionalism within the dispute resolution team and across the organisation.
  • Support continuous improvement initiatives to enhance dispute resolution processes, tools, and capabilities.
  • Contribute to the development of our client’s dispute resolution policies, procedures, and standards, ensuring alignment with industry best practices and emerging trends.
