Description:

MSC Cruises is seeking an experienced professional in Legal Compliance to join the Corporate Legal Group based in Geneva. As a key member of the team, you will collaborate with other legal colleagues, fostering a culture of teamwork, empathy, and curiosity. As the Head of Corporate Compliance, you will play a vital role in developing and managing MSC Cruises’ Corporate Compliance program globally, including at headquarters, regional offices, ashore and onboard. This position offers significant exposure to Senior Management, providing you with the opportunity to drive momentum within the organization.

The Corporate Compliance program is instrumental in supporting the company’s strategic vision by adopting a risk-based approach to meet stakeholder expectations and comply with legal requirements related to Sanction regimes, Anti-Bribery and Corruption, Anti-Money Laundering, and other regulatory frameworks.   • 10+ years post-qualification experience in compliance within a law firm and\/or legal department of a multinational company. Ideally, whilst not a pre-requisite, the candidate will have both law firm and corporate experience in a multinational company. Specific experience in the cruise sector is an advantage.
  • Law degree and\/or LLM; admission to a bar, post-graduate qualification in business related disciplines (finance audit, business administration) and compliance-certifications constitute a plus.
  • Perfect command of English (spoken and written). Fluency in other languages, with Italian and French being preferential ones, would be advantageous.
  • Strong communication and persuasion skills at all company levels.
  • Strong organizational skills and ability to prioritize and manage deadlines in a fast paced and rapidly evolving industry and work environment. Strong interpersonal and communication skills and teamwork.
  • Proactive, attention to detail and commitment to deliver work quality.
  • Knowledge of the Shipping, Travel and Transport industries is an asset.

The candidate will work under the supervision of the Chief Legal Officer and in cooperation with the Advisory and Audit Function and will be requested to:

  • Spread a Compliance and Ethics culture across the MSC Cruises Group at all levels of the operations, top down as well as bottom up.
  • Lead the compliance agenda, in collaboration with internal strategic partners, (i.e., Procurement, ESG) and identify, monitor and assess compliance related risks in relation to MSC Cruises operations.
  • Stay abreast of regulatory changes in the relevant compliance areas, and draft, develop and update at regular intervals policies and procedures, developing best practices and identifying country specific variations, to ensure adherence to applicable laws and regulations as appropriate.
  • Prepare and deploy training programs in concert with the Training & Development Organization.
  • Manage the global whistleblowing \/reporting platform, contributing to carrying out internal investigations pertaining to potential violations of the legal compliance areas and to taking relevant decision in conjunction with the the Operational Compliance Committee and the Internal Audit in close collaboration and alignment with all relevant internal and external stakeholders. The main in-scope legal and regulatory compliance areas are as follows: Anti-bribery & Corruption, Anti-Money Laundering, International Sanctions & PEPs, Conflicts of Interests, Code of Conduct misconduct and harassment (led by HR).
  • Assist in responding to request of competent authorities and stakeholders, participate in authorities’ investigations in collaboration with external law firms, local legal counsels.
  • Coordinate with Compliance and Financial Services at MSC Group level.
  • Assist in the due diligence of suppliers, partners, clients, including the operation of the passengers and crew members compliance screening platform.
  • Revise compliance related documents or clauses, to preserve the Company’s contractual interests with customers, suppliers or business partners.
  • Actively promote the building of a culture of best practice in compliance throughout the Company and its affiliates.VISA REQUIREMENTS (if any)
