Our client is seeking a highly skilled and experienced Senior Legal Counsel with a specialisation in construction litigation to join their dynamic team in Sydney. The successful candidate will play a crucial role in providing legal expertise and strategic guidance in navigating complex construction-related disputes. This role offers an exciting opportunity to work on high-profile projects and contribute to the growth and success of our client’s legal department.

QUALIFICATIONS:

  • Current practicing certificate.
  • Minimum of 8 years of legal experience, with a strong background in construction law and litigation.
  • Demonstrated expertise in managing complex construction disputes, including experience with major infrastructure projects.
  • Proven track record of successful outcomes in dispute resolution.
  • Excellent analytical, problem-solving, and decision-making skills, with a keen attention to detail.
  • Exceptional communication and interpersonal skills, with the ability to build strong relationships and collaborate effectively across departments and with external stakeholders.
  • Ability to work autonomously and manage multiple priorities in a fast-paced environment.

Responsibilities:

  • Provide expert legal advice and support on construction-related matters, with a focus on litigation and dispute resolution.
  • Manage a diverse caseload of construction disputes, including claims, litigation, arbitration, and mediation proceedings.
  • Collaborate closely with internal stakeholders, including project managers, engineers, and senior executives, to mitigate legal risks and ensure compliance with contractual obligations.
  • Conduct thorough legal research and analysis to support case strategies and provide recommendations to senior management.
  • Draft and review legal documents, including contracts, pleadings, briefs, and settlement agreements.
  • Represent our client in negotiations, mediations, and court proceedings, advocating for the company’s interests and achieving favourable outcomes.
  • Stay abreast of relevant laws, regulations, and industry developments to proactively identify emerging issues and opportunities.
  • Develop and deliver training programs and educational materials to internal stakeholders, enhancing their understanding of construction law principles, risk management strategies, and dispute resolution techniques.
  • Collaborate with external legal counsel and expert consultants as necessary, managing relationships and resources effectively to support litigation efforts and achieve favourable resolutions.
  • Advise on the interpretation and enforcement of construction contracts, identifying potential breaches, rights, and remedies available to our client, and devising strategies for contractual enforcement or defence.
  • Oversee the drafting, negotiation, and review of construction-related contracts, ensuring clarity, consistency, and compliance with legal requirements and best practices.
